Terms of Service of the app “Sunbeam Cats: Cozy Puzzle”
1. General provisions
- These terms set out the rules for using the mobile app “Sunbeam Cats: Cozy Puzzle” (application ID
com.hexeosoft.sunbeamcats, the “Game”) and are the terms referred to in Article 8 of the Polish Act of 18 July 2002 on providing services by electronic means. - The service provider is Mikołaj Badyl HexeoSoft, Polish tax ID (NIP) 6551992325, contact: contact@hexeosoft.com (“we”, “us”, the “Provider”).
- The “User” is anyone who uses the Game. If you use the Game as a consumer, you keep all the rights granted to you by consumer protection law; these terms do not limit them.
- By installing or using the Game, you accept these terms. They are available free of charge at this address and in the Game’s settings, and can be downloaded and saved at any time.
2. The service
- The Game is a logic puzzle: you move cats around a room so that each of them naps in the moving sunlight before sunset. It offers levels grouped into rooms of a house, a daily puzzle (Daily Nap), hints, a collection of cats, room decorations and saved progress.
- The Game is free and funded by ads. Optional paid items are available as in-app purchases (section 7).
- Using the Game does not require an account or any identifying data.
- The agreement for using the Game is concluded when you install it, for an indefinite period. You can terminate it at any time by uninstalling the Game.
- The Game is distributed through Google Play; the terms of that store also apply to downloads and updates.
3. Technical requirements
- You need a device with an Android version supported by the current version of the Game, as stated on Google Play.
- Levels can be played without an internet connection. An internet connection is needed to download and update the Game, to show ads, to collect statistics and for the Daily Nap.
4. Rules of use
When using the Game, you may not:
- modify, decompile or reverse engineer the Game’s code, except where mandatory law allows it;
- circumvent or block the Game’s mechanisms to obtain hints, stars or rewards in ways the Game does not provide for;
- artificially generate ad impressions or clicks (e.g. automatically or in exchange for a benefit), which also breaks the rules of the ad networks;
- distribute the Game’s levels for profit without our consent.
5. Stars, hints and other virtual items
- Stars, hints, cats and decorations are virtual items available only in the Game. You earn them by completing levels, by keeping a Daily Nap streak, by watching some ads voluntarily or, where offered, through in-app purchases.
- Virtual items have no monetary value and cannot be sold, transferred or exchanged for money or other benefits.
- Your progress and virtual items earned in the Game are stored on your device. Uninstalling the Game or clearing its data removes them permanently; we do not store them on servers. Items bought as in-app purchases can be restored with the same Google account (section 7).
- We may change how many stars or hints are awarded and what decorations cost to keep the Game balanced. Changes do not take away items you already have.
6. Ads
- The Game shows ads served by Google AdMob: interstitial ads, sometimes shown between levels, and rewarded ads that you watch only by your own choice. The Game shows no banner ads.
- The reward for a rewarded ad is granted by the Game once the ad has been watched to the end. If no ad is available (e.g. without internet), no reward is due.
- Advertisers are responsible for the content of their ads. If an ad concerns you, write to us – we can block its category.
- How data is processed in connection with ads is described in the Privacy Policy.
7. In-app purchases
- In the Game you can buy optional items, for example “Remove Ads”, hint packs, cat bundles or early access to a new room, when they are available. Every item’s content and current price including VAT are shown before the purchase in the Game and in the Google Play payment window. The Game has no random paid items (no loot boxes).
- “Remove Ads” permanently turns off interstitial ads. Rewarded ads remain available, because you watch them only by your own choice in exchange for a reward.
- Payments are handled by Google Play under its own rules (Google Play Terms of Service). We do not receive your card or other payment details.
- Permanent purchases (such as “Remove Ads” or cat bundles) are linked to your Google account. After reinstalling the Game, or on another device with the same account, they are restored automatically or with the “Restore purchases” button. Consumable items (such as hints) are used up when you use them and are not restored.
- Purchases are digital content supplied immediately. By starting a purchase, you consent to immediate supply and acknowledge that you thereby lose the right to withdraw from the contract (Article 38(1)(13) of the Polish Consumer Rights Act and the corresponding provisions of EU law). This does not limit your rights if the content does not conform to the contract (section 10); you can also get a refund under Google Play’s refund policy.
8. Content and copyright
- The Game, its artwork, code and levels are protected by copyright and belong to the Provider or are used under licence.
- The fonts and open-source components used in the Game are listed with their licences in the Game’s settings (Open-source licences).
- Levels are created with the help of automated tools and checked by a solver, but mistakes can still happen. Report them to contact@hexeosoft.com – we will fix them in a later version.
- We grant you a non-exclusive, non-transferable licence to use the Game on your device for private purposes for the duration of the agreement.
9. Liability
- We make every effort to keep the Game working correctly and available, but it may need breaks for updates, and features that depend on external services (ads, statistics, the Daily Nap) may be temporarily unavailable.
- We are not liable for the consequences of using the Game in breach of these terms or for the operation of third-party services (Google Play, ad networks), subject to mandatory law.
- This section does not limit liability towards consumers to the extent such a limitation would be unlawful, in particular for damage caused intentionally.
10. Complaints and consumer rights
- The Game is digital content supplied without a monetary payment but in exchange for data used for advertising, so consumers have the rights set out in Chapter 5b of the Polish Consumer Rights Act of 30 May 2014 and the corresponding EU rules, including the right to digital content that conforms to the contract.
- Send complaints, for example about the Game not working properly, a lost reward or a purchase, to contact@hexeosoft.com. Describe the problem and give your phone model and the Game version (shown in the Game’s settings).
- We will reply within 14 days of receiving the complaint.
- Consumers may use out-of-court complaint and redress procedures, for example consumer ombudsmen or, within the EU, the European Consumer Centres. Information for Polish consumers: prawakonsumenta.uokik.gov.pl.
- You can stop using the Game at any time by uninstalling it; no withdrawal statement is required. Withdrawal from in-app purchases is described in section 7.
11. Personal data
How data is processed, including consent to ads and statistics and your rights, is described in the Privacy Policy.
12. Changes to these terms
- We may change these terms for important reasons, in particular a change in the law, new features, a change of service providers or of the Game’s rules.
- We will inform you of changes in the Game at least 14 days before they take effect. If you do not accept them, you can stop using the Game and uninstall it.
13. Final provisions
- These terms are governed by Polish law. This choice of law does not deprive a consumer of the protection granted by the mandatory provisions of the law of the country of their habitual residence.
- Disputes with consumers are resolved by the court with jurisdiction under general rules.
- Matters not covered by these terms are governed by the Polish Civil Code, the Consumer Rights Act and the Act on providing services by electronic means.
